The issue of exercising the right to motherhood by women with HIV infection is finally resolved in Ukraine

MoH order from 22.04.2019 No 933, registered in the Ministry of Justice of Ukraine on May 15, 2019 with the No 506/33477, amended the Annex 1 to the Procedure of directing women for the first treatment schedule against infertility using the methods of assisted reproductive technologies for invariable indications at the expense of the budget funding.

Finally, the amendments resolved the issue of exercising the right to motherhood by women with HIV infection in a way of applying assisted reproductive technologies.

Order of MoH from 29.11.2004. No 579 “Approval of the procedure of directing women for the first treatment schedule against infertility using the methods of assisted reproductive technologies for invariable indications at the expense of the budget funding” (hereinafter Order # 579), which was amended, did not comply with the Law of Ukraine “On response to the diseases caused by the Human Immunodeficiency Virus (HIV), and legal and social protection of people living with HIV” and order of the MoH 16.05.2016 No 449 (as amended by the order from 02.07.2016 No 655), which approved the Unified clinical protocol of primary, secondary (specialized) and tertiary (highly specialized) healthcare services “Prevention of HIV transmission from a mother to a child”.

Amendments to the MoH Order No 579 were initiated by Charitable Organization “Positive Women” and International Charitable Organization “Eurasian Network of Women with AIDS”, and developed by Center for Public Health of the MoH of Ukraine. The amendments were advocated by Charitable Organization “100% LIFE”.

UHHRU participated in advocacy of the order adoptionin 2018 in the framework of the project “Development of the legal support network for protection of the people living with HIV/AIDS, vulnerable to HIV and ill with TB”.

Invaluable help in promotion of the MoH order was provided by Ukrainian MP Iryna Suslova.

The problem of access of HIV-positive women to ART was considered at parliamentary hearings on the topic: “Prevention and Counteraction of Discrimination of Women from Vulnerable Groups” (October 10 2018).
