UHHRU press conference “How to get compensation for property destroyed in eastern Ukraine?”

30January 2018

On Tuesday, 30 January, at 14:00 press conference “How to get compensation for property destroyed in eastern Ukraine?” will take place at Glavcom news agency (8/20 Shovkovychna St.).

Participants:

  • Mykhailo Tarakhkalo, director of UHHRU Strategic Litigation Center;
  • Vitaliya Lebid, lawyer of UHHRU Strategic Litigation Center;
  • Yuliya Naumenko, advocate of UHHRU Strategic Litigation Center;
  • Igor Kurilchuk, lawyer of UHHRU public reception office in Mariupol.

The participants will be analyzing implications of the new law “On the peculiarities of state policy on the restoration of the state sovereignty of Ukraine over temporarily occupied territories in Donetsk and Luhansk Oblasts” for the material compensation for citizens for losses suffered as a result of artillery fire. The new law contains a paragraph stating that the “Russian Federation is considered liable for immaterial and material damages caused to Ukraine and its citizens”. Does this mean that from now on it will be possible to sue Russia to get material compensation? How does this law affect the anti-terrorist operation status? In what territory will it be in force? How to get material compensation for the property destroyed as a result of artillery fire? What issues do affected Ukrainian citizens have to deal with? Which documents are necessary for a successful lawsuit, and how to prepare them? What does a standard lawsuit on material or immaterial damages look like? What to do when Ukrainian government agencies or Russian occupation authorities violate the rights of citizens in territories under or outside the control of the Ukrainian Government?
